Our general conditions of use are valid until 01/06/2023
The purpose of these general conditions of use (hereinafter referred to as the "GCU") is to provide a legal framework for the provision of the site and its services and to define the conditions of access to and use of the services by the "User".
These GCU are accessible on the site, in the footer, on the user login page.
Each user expressly accepts the present terms and conditions of use by checking the box preceding the following text: "I acknowledge that I have read and understood the terms and conditions of use and I accept them".
In the event of non-acceptance of the GCU stipulated in the present contract, the User must renounce access to the services offered by the site.
The www.xenesy.com website reserves the right to unilaterally modify the content of these GCU at any time by notifying all users.
Any registration or use of the site implies the user's unreserved and unrestricted acceptance of these GCU. When registering on the site via the "registration form", each user expressly accepts these GCU by checking the box preceding the following text: "I acknowledge having read and understood the GCU and I accept them".
Article 1 - Legal information
The purpose of the www.xenesy.com website is to provide information about all the company's activities.
XENESY LIMITED makes an effort to provide on the site www.xenesy.com information as precise as possible. However, it could not be held responsible for the omissions, the inaccuracies and the deficiencies in the update, that they are of its fact or of the fact of the third partners who provide him this information.
All the information on the www.xenesy.com website is given as an indication, and is likely to change. Moreover, the information on the site www.xenesy.com is not exhaustive. It is given subject to modifications having been made since it was put on line.
Article 2 - Access to the site and to the Backoffice provided for in our general conditions of use (Members' Area)
The site is accessible free of charge from any location to any User with Internet access and password. All costs incurred by the User to access the service (hardware, software, Internet connection, etc.) are at the User's expense.
Non-member Users do not have access to reserved services. To do so, they must register by completing the registration form in the "Registration" tab on the www.xenesy.com website. By agreeing to register for the reserved services, the member User undertakes to provide truthful and accurate information concerning his civil status and contact details, in particular his e-mail address and mobile telephone number.
To access the services, the User must first click on the activation link received by e-mail and then identify him/herself using a username and password chosen at the time of registration.
www.xenesy.com shall not be held liable for any event of force majeure resulting in malfunction of the site or server, subject to any interruption or modification for maintenance purposes. In such cases, the User agrees not to hold the publisher responsible for any interruption or suspension of service, even without prior notice.
The User may contact the site by e-mail at the publisher's e-mail address given in ARTICLE 1.
Article 3 - Data collection (see Hong Kong legislation)

That said, each referring executive follows the legislation in force in his or her country (RGPD for France...). What's more, all data is stored on secure private servers.

Article 5 - Liability applied in our general conditions of use
The sources of the information published on www.xenesy.com are deemed reliable, but the site does not guarantee that it is free from defects, errors or omissions.

Despite regular updates, the www.xenesy.com website cannot be held responsible for any changes in administrative or legal provisions occurring after publication. The site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.
Article 6 - Hypertext links
Hypertext links may be present on the site. Users are informed that by clicking on these links, they will leave the www.xenesy.com site. The latter has no control over the web pages to which these links lead and cannot, under any circumstances, be held responsible for their content.
Article 7 - Cookies
The User is informed that when visiting the site, a cookie may be automatically installed on his/her browser.
Cookies are small files stored temporarily on the hard disk of the User's computer by your browser and which are necessary for the use of the www.level-up-invest.com website. Cookies do not contain any personal information and cannot be used to identify anyone. A cookie contains a unique identifier, randomly generated and therefore anonymous. Some cookies expire at the end of the User's visit, others remain.

Article 8 - Applicable law and jurisdiction
The regulations in force are those of Hong Kong (Dubai International Finance Centre) and the competent jurisdiction in the event of disputes is that of Hong Kong.
Article 9 - Use of the BackOffice
Once registered on the www.xenesy.com website, the general conditions of use stipulate that the User can access his backoffice via the personalized link sent to him by e-mail. He will be able to log in with his e-mail address and the password sent by e-mail.
*Once logged in, the User can sign the partnership agreement in the "Profile and Documents" tab, and import supporting documents such as a passport and proof of address.
Users can deposit their investment via the "Finance - Deposit" tab, set payment and withdrawal parameters in the "Finance - Withdrawal method" tab, transfer capital from their deposit balance to their withdrawal balance in the "Finance - Transfer" tab, and withdraw commissions in the "Finance - Withdrawal" tab.
The deposit is credited to the backoffice by the company within 2 to 5 working days, and the User can select his investment offer via the "Investment" tab.
The User can track all his transactions in his back office (main page): deposit transactions, transfer transactions, withdrawal transactions.
*For each withdrawal made, the User will be charged a 2% withdrawal fee of the amount requested.
Finally, for any queries or problems, the User can submit a ticket in the "Support" tab.
Article 10 - Investment Offers
All investment offers can only be acquired via the deposit balance.
Each investment offer commits the User for 12 months.
*Each investment cycle runs from the 16th of the month to the 14th of the following month, and the User receives annuities according to the following model and example:
- The User will be able to invest in investment offers with an annual annuity.
- An investment of 5,000 euros in the offer could potentially result in a transformed capital of up to 500%, or 25,000 euros, and the 13th month back.
- An investment of between 10,000 and 20,000 euros could potentially result in a transformed capital of up to 500%, i.e. 50,000 to 100,000 euros, returned in the 13th month.
- The User may not upgrade the annual investment offer from 5,000 euros and 10,000 euros to 20,000 euros.
Article 10 .1
All new shareholders will be required to pay a fee of 1,000 euros to cover the cost of transferring shares in Xenesy LTD to shareholders.
Article 11 - Breach of contract
The associate may terminate his partnership with Xenesy LTD by selling his shares. The return of capital takes place according to the following procedures:

Article 12 - Age restrictions
Users agree that by using our website www.xenesy.com, they are over 18 years of age. We assume no legal liability for misrepresentation of age.
12.1-Applicable law and jurisdiction :
These terms and conditions are subject to the jurisdiction of Hong Kong.
In the event of a dispute, the courts of Hong Kong shall have exclusive jurisdiction.
Article 13 - Independence of contract clauses :
Should any of the provisions of these general terms and conditions of sale be declared invalid by the competent court, the remaining provisions shall not be affected and shall retain their full force and scope.
Article 14 - Protection of personal data
Data collected:
The personal data that are collected on this site are the following:
- account opening: when a user's account is created, the user's surname; first name; e-mail address; ;
- connection: when the user connects to the website, it records, in particular, his/her surname, first name, connection data, usage data, location data and payment data;
- profile: using the services provided on the website allows you to enter a profile, which may include an address and telephone number;
- payment: when paying for products and services offered on the website, the website records financial data relating to the user's bank account or credit card;
- communication: when the website is used to communicate with other members, data concerning the user's communications is stored temporarily;

Changes to this clause of the general conditions of use
The company XENESY LIMITED reserves the right to make any changes to this clause on the protection of personal data at any time. If a modification is made to the present personal data protection clause, the company undertakes to publish the new version on its website. Xenesy will also inform users of the modification by e-mail, at least 15 days before the effective date. If the user does not agree with the terms of the new wording of the personal data protection clause, he/she has the option of deleting his/her account.
